Terms and Conditions
Last updated: November 2026
1. What Tangaza-Mtaani does
Tangaza-Mtaani lets Kenyan shops build a customer list with a QR code, publish product pages, and send updates and shop news by SMS and WhatsApp. By creating an account you agree to these terms.
2. Your account
You sign in with your phone number and a 4-digit PIN. Keep your PIN secret — you are responsible for everything sent from your account. One account per business. You must be 18 or older and legally able to run your business.
3. Plans and fair use
Free: 1 product, up to 50 customers, 50 SMS a month, SMS only — free forever. Standard (KES 199/month): 10 products, up to 200 customers, 200 SMS plus WhatsApp. Premium (KES 1,499/month): 50 products, up to 2,000 customers, 2,000 SMS plus WhatsApp. Limits reset monthly. Unused messages do not carry over. We may change plans and prices with reasonable notice.
4. Honest messaging — no scams
Every message you send through Tangaza-Mtaani must be true. You must not:
- Send false prices, fake discounts, or products you do not have.
- Pretend to be another business or person.
- Send spam, bulk messages to strangers, or messages customers did not ask for.
- Advertise illegal goods or services, or break any Kenyan law.
Send only to customers who joined your list through your QR code or gave you their number directly, and remove anyone who asks to leave.
5. What happens if you misuse Tangaza-Mtaani
If we find you sending misleading information, spam, or scam messages, we will suspend or permanently close your account without refund, and we may block your phone number from opening a new one.
Serious misuse — fraud, extortion, impersonation, or messages that steal from or harm customers — will be reported to the Directorate of Criminal Investigations (DCI) and the Communications Authority of Kenya, and we will cooperate fully with investigators. You remain personally responsible for every message sent from your account, and affected customers or Tangaza-Mtaani may take the matter to the Kenyan courts to recover losses. Nothing in these terms limits criminal liability under Kenyan law.
6. Your content
You own your product photos, business details and messages, and you confirm you have the right to publish them. You give Tangaza-Mtaani permission to store and display them as needed to run the service, including public product pages and message delivery.
7. Service availability
We work to keep Tangaza-Mtaani running, but SMS and WhatsApp delivery depends on mobile networks and third-party providers. We cannot guarantee every message arrives, and we are not liable for lost sales from delayed or failed delivery, network outages, or maintenance downtime.
8. Payments and refunds
Paid plans are billed monthly in advance through Paystack (M-Pesa or card) and activate automatically once payment goes through. Talk to us to downgrade or cancel — cancellation stops future billing. Months already started are not refunded, and accounts closed for misuse receive no refund.
9. Ending the service
You may stop using Tangaza-Mtaani and ask us to delete your account at any time. We may suspend or end accounts that break these terms, stay inactive for a long period, or abuse the service. Sections 4, 5 and 10 survive termination.
10. Governing law
These terms are governed by the laws of Kenya. Any dispute will first be discussed in good faith; if unresolved, it will be heard by the courts of Kenya.
11. Changes
We may update these terms and will post the new version here with a new date. Continuing to use Tangaza-Mtaani after a change means you accept it.
